These Terms, Conditions, and Privacy Policy (“Terms”) apply to all loyalty and rewards programs operated through LocalLoop™, a platform owned and managed by Najah Pty Ltd ABN 11 165 433 858 (“LocalLoop™,” “we,” “our,” “us”).

Each participating store (“Retailer”) operates its own LocalLoop™ program under its own business name and ABN. Unless otherwise stated, promotions, vouchers, and prize draws are valid only at the issuing Retailer’s location.

References to “we,” “our,” or “us” throughout these Terms may refer to either LocalLoop™ (as platform provider) or the participating Retailer (as operator of the specific program).

By joining or using any LocalLoop™-powered program, you agree to these Terms and the accompanying Privacy Policy.

Terms and Conditions

    GENERAL SCOPE

    1) These Terms apply to all retailers participating in the LocalLoop™ Rewards Program (“Program”) operated by Najah Pty Ltd on behalf of participating Retailers.

    2) By joining or participating in any LocalLoop™ program, you (“Member,” “you,” “your”) agree to these Terms.

    3) Each participating Retailer operates independently under its own ABN and business name. LocalLoop™ provides only the technology and administrative platform that enables this Program.

    MEMBERSHIP CONDITIONS

    4) Membership is open to Australian residents aged 18 years or over.

    5) Only one account per individual is permitted.

    6) Membership is free, voluntary, and may be cancelled at any time by contacting the participating Retailer or LocalLoop™ support.

    7) LocalLoop™ or any participating Retailer may suspend, terminate, or refuse membership in cases of suspected fraud, abuse, or non-compliance.

    8) Participation constitutes acceptance of these Terms and any future amendments published on the program site or app.

    9) LocalLoop™ reserves the right to audit member or retailer activity and to suspend or terminate any account where fraudulent or abusive behaviour is suspected.

    EARNING AND REDEEMING REWARDS

    10) Rewards may include loyalty points, vouchers, coupons, or other promotional incentives.

    11) Rewards are non-transferable, non-exchangeable, and not redeemable for cash.

    12) Points, credits, and vouchers must be used within the validity period stated on the voucher or app and may expire thereafter.

    13) Each Retailer determines which products or purchases are eligible for rewards and may change these at any time without notice.

    14) LocalLoop™ and participating Retailers may modify, suspend, or terminate any aspect of the Program with reasonable notice.

    15) LocalLoop™ does not guarantee continuous availability of the Program and is not liable for losses arising from technical faults, downtime, or communication delays.

    MONTHLY PRIZE DRAWS (TRADE PROMOTIONS)

    16) Prize draws are conducted on or around the 21st of each month from all eligible members who checked in, tapped, or made qualifying purchases in the previous period.

    17) Winners will be notified by SMS or email and must collect their prize before the end of that month.

    18) Prizes are valid for the nominated period unless otherwise stated.

    19) Prizes are not redeemable for cash and may be substituted at LocalLoop™ or the Retailer’s discretion if unavailable.

    20) Prize value and availability may vary monthly without notice.

    21) All draws are conducted fairly and at random. The decision of LocalLoop™ or the Retailer is final.

    22) LocalLoop™ and participating Retailers may verify the identity and eligibility of winners and disqualify entries that breach these Terms.

    23) Where required by law (NSW, ACT, SA or based on prize value), the Retailer will obtain and display the relevant trade-promotion permit or authority number.

    24) Employees, contractors, and immediate family members of LocalLoop™ or the Retailer are ineligible.

    25) If a prize remains unclaimed by month-end, a redraw may occur on the first business day of the following month, or the prize may be forfeited at the Retailers sole discretion.

    26) By accepting a prize, winners consent to publication of their first name and suburb unless they request otherwise in writing.

    VOUCHERS AND PROMOTIONS

    27) Voucher conditions (minimum spend, expiry, eligible categories) are specified on each voucher.

    28) Only one voucher may be used per transaction unless otherwise stated.

    29) Lost, stolen, or expired vouchers will not be reissued or refunded.

    30) Retailers may verify the identity or membership status of voucher holders before honouring rewards.

    31) Promotional offers cannot be combined with other discounts or coupons unless stated.

    INDEPENDENT RETAILER RESPONSIBILITY

    32) All promotions, offers, and rewards are created and administered solely by the participating Retailer.

    33) LocalLoop™ does not control or guarantee any Retailer’s promotional content, pricing, product availability, or compliance.

    34) Each Retailer is responsible for compliance with all applicable consumer and fair-trading laws.

    35) LocalLoop™ acts only as a technology facilitator and accepts no liability for Retailer errors or misrepresentations.

    36) Each Retailer indemnifies Najah Pty Ltd (LocalLoop™) against any loss or cost arising from its own conduct.

    37) Customer enquiries, complaints, refunds, or redemptions relating to purchases or rewards must be directed to the issuing Retailer.

    38) Each Retailer is responsible for its own taxation and compliance obligations.

    39) Retailers grant Najah Pty Ltd a non-exclusive, royalty-free licence to use their trade name and logo for Program purposes.

    LIMITATION OF LIABILITY

    40) To the maximum extent permitted by law, LocalLoop™ and participating Retailers are not liable for any loss, damage, or injury arising from participation in the Program or acceptance of any prize or voucher.

    41) Nothing in these Terms limits your rights under the Australian Consumer Law.

    42) LocalLoop™ makes no warranties regarding uninterrupted access, error-free operation, or specific commercial outcomes.

    DATA PRIVACY POLICY

    43) LocalLoop™ and participating Retailers are committed to protecting your privacy under the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), the Spam Act 2003 (Cth), and GDPR (EU).

    44) Data collected through LocalLoop™ is securely hosted in Australia by Najah Pty Ltd and authorised service providers.

    45) Personal data is never sold, rented, or shared with unaffiliated third parties for their own marketing purposes.

    46) Communications may include sponsored messages or advertising placements; advertisers do not receive access to personal data.

    47) Where hosting or integrations involve overseas storage (e.g., EU or US servers), LocalLoop™ relies on Standard Contractual Clauses and equivalent safeguards under APP 8 and GDPR Articles 44-49.

    48) Information collected may include identifiers, transaction and visit data, device or browser data, geolocation (check-in) data, and communication preferences.

    49) Data is used to administer membership, deliver rewards and prize draws, send updates, provide support, analyse usage, and meet legal obligations.

    50) Lawful bases for processing include Consent, Contract, and Legitimate Interest (GDPR Articles 6-7).

    51) Each participating Retailer acts as an independent data controller for information collected directly in-store.

    52) You have the right to access, correct, delete, restrict, or object to processing, request data portability, or withdraw consent at any time by contacting admin@loyaltyclubmembers.com.

    53) Requests are processed within 30 days in accordance with APP 12-13 and GDPR Articles 15-20. You may also request an internal review if dissatisfied with our response.

    54) Complaints may be lodged with the Office of the Australian Information Commissioner (OAIC) if unresolved.

    55) We protect personal data using encryption, role-based access controls, internal security audits, and secure destruction after retention periods expire.

    56) Personal data is retained for up to 24 months after last activity unless legal obligations require longer retention, then securely deleted or anonymised.

    57) In the event of a notifiable data breach, we will notify affected individuals and the OAIC as required under Part IIIC of the Privacy Act.

    58) Our websites and apps may use cookies or similar technologies; disabling them may affect functionality.

    GEOLOCATION AND NFC CHECK-INS

    59) When a Member taps or scans an NFC tag, the system may request temporary location access to verify the check-in within the approved geofenced area.

    60) Location access is used solely for one-time validation; continuous tracking is not performed. Members may withdraw consent via device settings at any time.

    61) Denying location access may prevent successful check-in or reward allocation.

    62) LocalLoop™ complies with all privacy laws governing the limited use of geolocation information.

    COMMUNICATIONS AND OPT-OUT (SPAM ACT COMPLIANCE)

    63) Members agree to receive Program communications (email, SMS, push). Each message identifies the sender and includes an unsubscribe option.

    64) You may opt out at any time via the unsubscribe link or email admin@loyaltyclubmembers.com; requests are processed within 5 working days.

    65) Opting out of marketing does not affect essential notifications such as voucher delivery or prize confirmation.

    66) Some communications may contain partner offers sent by LocalLoop™ without sharing your personal data.

    RECORD-KEEPING (PROMOTIONS)

    67) LocalLoop™ and Retailers maintain records of promotions, draw methods, winners, and permits for the periods required by law.

    INDEMNITY AND ENTIRE AGREEMENT

    68) To the fullest extent permitted by law, each Retailer and Member indemnifies Najah Pty Ltd (LocalLoop™) from any claim, cost, damage, or liability arising from participation or misuse of the Program.

    69) If any provision is held invalid or unenforceable, the remaining provisions remain in full force. These Terms constitute the entire agreement between the parties.

    INTELLECTUAL PROPERTY

    70) All intellectual property in LocalLoop™, LocalLink™, MarketLoop™, and SentryLoop™ brands and content is owned by Najah Pty Ltd. All rights reserved.

    DISPUTE RESOLUTION AND GOVERNING LAW

    71) Before commencing legal proceedings, both parties agree to attempt in good faith to resolve disputes through negotiation or mediation facilitated by an independent mediator such as the Resolution Institute (Australia).

    72) These Terms are governed by the laws of Victoria, Australia, and the courts of Victoria have non-exclusive jurisdiction.

    UPDATES TO THESE TERMS

    74) We may update these Terms from time to time. The current version will always appear on participating Retailers’ program websites. Continued participation constitutes acceptance of the revised Terms.

    84) All sub-processors are bound by confidentiality and data-protection obligations consistent with the Australian Privacy Principles (APPs) and GDPR requirements.
