
Terms, Conditions & Privacy Policy
Each participating store (“Retailer”) operates its own LocalLoop™ program under its own business name and ABN. Unless otherwise stated, promotions, vouchers, and prize draws are valid only at the issuing Retailer’s location and are not affiliated with or redeemable at any other store.
References to “we,” “our,” or “us” throughout these Terms may refer to either LocalLoop™ (as platform provider) or the participating Retailer (as operator of the specific program).
By joining or using any LocalLoop™-powered program, you agree to these Terms and the accompanying Privacy Policy.

LocalLoop™ Retailer Terms, Conditions & Privacy Policy

GENERAL SCOPE
1. These Terms and Conditions and Privacy Policy (“Terms”) apply to all retailers participating in the LocalLoop™ Rewards Program (“Program”) operated by Najah Pty Ltd ABN 11 165 433 858 (“LocalLoop™,” “we,” “our,” “us”) on behalf of participating retailers (“Retailer”).
2. By joining or participating in any LocalLoop™ program, you (“Member,” “you,” “your”) agree to these Terms.
3. Each participating Retailer operates independently under its own ABN and business name. LocalLoop™ provides only the technology and administrative platform that enables this Program.
MEMBERSHIP CONDITIONS
4. Membership is open to Australian residents aged 18 years or over; minors are not eligible.
5. Only one account per individual is permitted and an individual may only register 1 email address.
6. Membership is free, voluntary, and may be cancelled at any time by contacting the participating Retailer or LocalLoop™ support.
7. LocalLoop™ and participating Retailers may suspend, terminate, or refuse membership in cases of suspected fraud, abuse, or non-compliance.
8. Participation in the Program constitutes acceptance of these Terms and any future amendments published on the program site or app.
9. LocalLoop™ reserves the right to audit member or retailer activity and to suspend or terminate any account where fraudulent or abusive behaviour is suspected.
EARNING AND REDEEMING REWARDS
10. Rewards may include loyalty points, vouchers, coupons, or other promotional incentives.
11. Rewards are non-transferable, non-exchangeable, and not redeemable for cash.
12. Points, credits, and vouchers must be used within the validity period stated on the voucher or app and may expire thereafter.
13. Each Retailer determines which products, categories, or purchases are eligible for rewards and may change these at any time without notice.
14. LocalLoop™ and participating Retailers may modify, suspend, or terminate any aspect of the Program with reasonable notice.
15. LocalLoop™ does not guarantee continuous availability of the Program and is not liable for losses arising from technical faults, downtime, or communication delays.
MONTHLY PRIZE DRAWS (TRADE PROMOTIONS)
16. A random prize draw will be conducted on or around the 21st of each month from all eligible members who have checked in, tapped, or made qualifying purchases during the previous period.
17. Winners will be notified by SMS or email and must collect their prize before the end of that month.
18. Prizes (including vouchers) are valid for the nominated period, usually the following month unless otherwise stated.
19. Prizes are not redeemable for cash and cannot be transferred or substituted except at LocalLoop™ or the Retailer’s discretion if a prize becomes unavailable.
20. Prize availability and value may vary monthly and are subject to change without notice.
21. All draws are conducted fairly and at random. The decision of LocalLoop™ or the participating Retailer is final and no correspondence will be entered into.
22. LocalLoop™ and participating Retailers reserve the right to verify the identity and eligibility of winners and to disqualify entries that breach these Terms or manipulate the system.
23. Where required by law (NSW, ACT, SA or based on prize value), the Retailer will obtain and display the relevant trade-promotion permit or authority number.
24. Employees, contractors, and immediate family members of LocalLoop™ or participating Retailers directly involved in administering the promotion are ineligible to enter.
25. If a prize remains unclaimed by the end of the month, a redraw may occur on the first business day of the following month using the same draw method, or be forfeited at the store owners discretion.
26. By accepting a prize, winners consent to their name and suburb being sent to all members via email in the monthly prize draw results email, and to be used for reasonable publicity unless they request otherwise in writing.
VOUCHERS AND PROMOTIONS
27. Voucher conditions (minimum spend, expiry, eligible categories) are specified on each voucher.
28. Only one voucher may be used per transaction unless otherwise stated.
29. Lost, stolen, or expired vouchers will not be reissued or refunded.
30. Retailers may verify the identity or membership status of voucher holders before honouring rewards. Retailers reserve the right to deny any voucher that they deem has been obtained fraudulently, including multiple attempts to print or otherwise copy and claim vouchers.
31. Promotional offers cannot be combined with other discounts or coupons unless stated.
INDEPENDENT RETAILER RESPONSIBILITY
32. All promotions, offers, discounts, and rewards advertised or communicated through the LocalLoop™ platform are created and administered solely by the participating Retailer.
33. LocalLoop™ (Najah Pty Ltd) does not control, endorse, or guarantee any individual Retailer’s promotional content, pricing, product availability, or compliance with applicable laws.
34. The Retailer is fully responsible for ensuring that all promotions and offers comply with the Australian Consumer Law, state and territory fair-trading legislation, and any relevant industry codes.
35. LocalLoop™ acts only as a technology and communications facilitator and accepts no liability for errors, omissions, or misrepresentations made by participating Retailers.
36. Each participating Retailer agrees to indemnify and hold harmless Najah Pty Ltd (LocalLoop™) from and against any loss, liability, cost, or expense arising from that Retailer’s promotions, offers, or conduct in connection with the Program.
37. Any customer enquiries, complaints, refunds, or redemptions relating to purchases or rewards must be directed to the issuing Retailer. Najah Pty Ltd (LocalLoop™) is not responsible for resolving or mediating consumer disputes.
38. Each Retailer is solely responsible for compliance with all applicable taxation, accounting, and regulatory requirements relating to their participation in the Program.
39. Retailers grant Najah Pty Ltd a non-exclusive, royalty-free licence to use their trade name and logo solely for Program administration and promotional purposes.
LIMITATION OF LIABILITY
40. To the maximum extent permitted by law, LocalLoop™ and participating Retailers are not liable for any loss, damage, or injury arising from participation in the Program or acceptance of any prize or voucher.
41. Nothing in these Terms limits your rights under the Australian Consumer Law (Cth).
42. LocalLoop™ makes no warranties regarding uninterrupted access, error-free operation, or specific commercial outcomes.
DATA PRIVACY POLICY
43. LocalLoop™ and participating Retailers are committed to protecting your privacy in compliance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), the Spam Act 2003 (Cth), and the GDPR (EU).
44. Data collected through LocalLoop™ is securely hosted in Australia by LocalLoop™ (Najah Pty Ltd) and its authorised service providers.
45. Personal data is never sold, rented, or shared with unaffiliated third parties for their own marketing purposes.
46. LocalLoop™ communications may include sponsored messages or advertising placements within emails or newsletters. Advertisers do not receive access to personal data; all targeting and delivery are managed internally by LocalLoop™.
47. Where cloud hosting or integrations involve overseas storage (e.g., EU or US servers), adequate data-protection safeguards consistent with GDPR Articles 44–49 are maintained.
48. The information we collect may include personal identifiers, transaction and visit data, device or browser data, geolocation (check-in) data, and communication preferences.
49. We collect this information to administer membership, deliver rewards and prize draws, send updates and offers, provide support, analyse aggregate behaviour, and comply with legal obligations.
50. The lawful bases for processing personal data include Consent, Contract, and Legitimate Interest (as defined in GDPR Articles 6–7).
51. Each participating Retailer acts as an independent data controller for any personal information they collect directly in-store. LocalLoop™ is not responsible for the Retailer’s independent data practices beyond the operation of this platform.
52. You have the right to access, correct, delete, or request portability of your data and to withdraw consent or opt out of marketing at any time by contacting admin@loyaltyclubmembers.com.
53. All privacy requests are actioned within 30 days in accordance with Australian Privacy Principles 12 and 13 and GDPR Articles 15–20.
54. If you believe we have breached your privacy rights, you may contact us and, if unresolved, lodge a complaint with the Office of the Australian Information Commissioner (OAIC).
55. We protect personal data using encryption, role-based access controls, security audits, and secure destruction after retention periods expire.
56. Personal data is retained only as long as necessary to operate the Program or meet legal requirements, then securely deleted or anonymised.
57. In the event of a notifiable data breach, we will notify affected individuals and the OAIC as required under Part IIIC of the Privacy Act.
58. Our websites and apps may use cookies and similar technologies to remember preferences, prevent fraud, and measure performance. You can manage cookies via browser settings; some features may not function without them.
GEOLOCATION AND NFC CHECK-INS
59. When a Member taps or scans an NFC tag to check in at a participating Retailer, the LocalLoop™ system may request temporary access to the device’s location services to verify that the check-in occurs within the approved geofenced area.
60. Location access is used solely for one-time validation of visit authenticity; LocalLoop™ does not store continuous GPS data or track Members outside of that single event.
61. Members will be prompted by their device to allow or deny location access each time; refusal may prevent successful check-in or reward allocation.
62. LocalLoop™ complies with all relevant privacy and data-protection laws governing the collection and limited use of geolocation information.
COMMUNICATIONS AND OPT-OUT (SPAM ACT COMPLIANCE)
63. Members agree to receive Program communications (email, SMS, push). Each message will identify the sender and include a functional unsubscribe option as required by the Spam Act 2003 (Cth).
64. You may opt out at any time via the unsubscribe link or by emailing admin@loyaltyclubmembers.com; opt-outs are processed within five working days.
65. Opting out of marketing does not affect essential service notifications such as voucher delivery or prize confirmation.
66. Some communications may contain information or offers from LocalLoop™ partners or advertisers. Such messages are sent by LocalLoop™ and do not involve sharing your personal data with those partners.
RECORD-KEEPING (PROMOTIONS)
67. LocalLoop™ and Retailers maintain records of promotions, draw methods, winners, and permits for the periods required by law in each jurisdiction.
INDEMNITY AND ENTIRE AGREEMENT
68. To the fullest extent permitted by law, each Retailer and Member agrees to indemnify and hold harmless Najah Pty Ltd (LocalLoop™) from any claim, cost, damage, or liability arising out of their participation in or misuse of the Program.
69. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. These Terms constitute the entire agreement between the parties regarding the Program.
INTELLECTUAL PROPERTY
70. All intellectual property in LocalLoop™, LocalLink™, MarketLoop™, and SentryLoop™ brands and content is owned by Najah Pty Ltd. All rights reserved.
DISPUTES AND GOVERNING LAW
71. These Terms are governed by the laws of Victoria, Australia, and the courts of Victoria have non-exclusive jurisdiction.

73. We may update these Terms from time to time. The current version will always appear on participating Retailers’ program websites. Continued participation constitutes acceptance of the revised Terms.
